Terms Of Use
Welcome to Southern California Pool Table Movers (hereinafter “SCPTM”). SCPTM provides a website (the “Site”) located at https://southcapooltablemovers.com and related services (collectively, the “Services”) subject to the following terms of use (the “Terms of Use”). The Services are offered to you, the user, conditioned upon your acceptance without modification of the Terms of Use. By visiting, browsing, and/or using the Site and/or Services, you acknowledge that you have read, understand, and agree to be bound by the Terms of Use.
1. Use of the Site and Services. The Site and Services are intended solely for personal, noncommercial use. You may not use the Site and Services for any other purpose, including any commercial purpose, without SCPTM’s express prior written consent.
2. Prohibited Uses. You may not use the Site or Services in any manner that could damage, disable, overburden, or impair the Site or Services, or interfere with any other party’s use and enjoyment of the Site or Services. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site or Services.
3. User Content. You may be able to submit, upload, post, or otherwise make available certain content to the Site or Services (collectively, “User Content”). You retain all ownership rights in and to your User Content. However, by submitting, uploading, posting, or otherwise making available your User Content, you grant SCPTM a nonexclusive, royalty-free, perpetual, transferable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media, now known or hereafter devised.
4. Disclaimers. The Site, Services, and User Content are provided on an “as is,” “as available” basis. SCPTM expressly disclaims all warranties, conditions, and other terms of any kind, whether express or implied, including but not limited to any implied terms of merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement.
5. Limitation of Liability. In no event shall SCPTM be liable for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive, or incidental damages, or damages for loss of use, profits, data, or other intangibles, damages related to your use of the Site, Services, or User Content, unauthorized access to or alteration of your transmissions or data, or any other matter, even if SCPTM has been advised of the possibility of such damages.
6. Indemnification. You agree to indemnify and hold SCPTM, its affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of User Content you submit, post, transmit, or otherwise make available through the Site or Services, your use of the Site or Services, your connection to the Site or Services, your violation of the Terms of Use, or your violation of any rights of another.
7. Miscellaneous. The Terms of Use constitute the entire agreement between you and SCPTM and govern your use of the Site and Services, superseding any prior agreements between you and SCPTM with respect to the Site or Services. You also may be subject to additional terms and conditions that may apply when you use or purchase certain other SCPTM services, affiliate services, third-party content, or third-party software. The Terms of Use and the relationship between you and SCPTM shall be governed by the laws of the State of California without regard to its conflict of law provisions. You and SCPTM agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Ventura, California. The failure of SCPTM to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision. If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Site or Services or the Terms of Use must be filed within one (1) year after such claim or cause of action arose or be forever barred.
8. Changes to the Terms of Use. SCPTM reserves the right, at its sole discretion, to change, modify, add, or delete portions of the Terms of Use at any time without further notice. If SCPTM does this, it will post the changes to the Terms of Use on this page and will indicate at the top of this page the date the Terms of Use were last revised. Your continued use of the Site or Services after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the Site or Services. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.
